Grand Jury for the District of Nebraska

United States Attorney Susan Lehr has announced that the Federal Grand Jury for the District of Nebraska has returned nine (9) unsealed indictments against ten defendants. Indictments are charging documents that contain one or more individual charges that are merely accusations, and each defendant is presumed innocent unless and until proven guilty.

Scott D. NelsonNelson, 53, of Council Bluffs, Iowa, is charged in a two-count indictment. Count I charges Nelson with sex trafficking of a minor on or about December 1, 2023, through August 9, 2024. The maximum possible penalty if convicted is a minimum of 10 years and a maximum of life in prison, a $250,000 fine, a period of supervised release of a minimum of five years and a maximum of life in prison, and a $100 special levy. Count II charges Nelson with sexual exploitation of children on or about December 1, 2023, through August 9, 2024. The maximum possible penalty if convicted is a minimum of 15 years and a maximum of 30 years in prison, a $250,000 fine, a period of supervised release of a minimum of five years and a maximum of life in prison, and a $100 special levy.

Mike Marquez42 years old, of Omaha, Nebraska, is charged with distribution of fentanyl resulting in death on or about June 23, 2024. The maximum possible penalty if convicted is a minimum of 20 years and a maximum of life in prison, a fine of $10,000,000, a period of probation of at least three years and a maximum of life in prison, and a special levy of $100.

Clayton Reynolds31-year-old from Omaha, Nebraska, is charged in an eight-count indictment. Count I charges Reynolds with distribution of fentanyl on or about April 8, 2024. The maximum possible sentence upon conviction is a maximum of 20 years’ imprisonment, a fine of $1,000,000, a period of supervised release of not less than three years and a maximum of life imprisonment, and a special levy of $100. Count II charges Reynolds with distribution of fentanyl on or about April 23, 2024. The maximum possible sentence upon conviction is a maximum of 20 years’ imprisonment, a fine of $1,000,000, a period of supervised release of not less than three years and a maximum of life imprisonment, and a special levy of $100. Count III charges Reynolds with possession of a firearm during a drug trafficking offense on or about April 23, 2024. The maximum possible sentence upon conviction is not less than 5 years and a maximum of life imprisonment, a fine of $250,000, a period of supervised release of not more than five years, and a special levy of $100. Count IV charges Reynolds with distribution of fentanyl on or about June 12, 2024. The maximum possible penalty upon conviction is up to 20 years’ imprisonment, a fine of $1,000,000, a period of supervised release of not less than three years and up to life in prison, and a special levy of $100. Count V charges Reynolds with distribution of fentanyl on or about June 26, 2024. The maximum possible penalty upon conviction is up to 20 years’ imprisonment, a fine of $1,000,000, a period of parole of not less than three years and up to life in prison, and a special levy of $100. Count VI charges Reynolds with distribution of fentanyl on or about July 15, 2024. The maximum possible penalty upon conviction is up to 20 years’ imprisonment, a fine of $1,000,000, a period of parole of not less than three years and up to life in prison, and a special levy of $100. Count VII charges Reynolds with possession with intent to distribute 500 grams or more of methamphetamine on or about July 22, 2024. The maximum possible penalty upon conviction is not less than 10 years and a maximum of life imprisonment, a fine of $1,000,000, a period of supervised release of not less than three years and a maximum of life imprisonment, and a special assessment of $100. Count VIII charges Reynolds with possession of a firearm during a drug trafficking offense on or about July 22, 2024. The maximum possible penalty upon conviction is not less than 5 years and a maximum of life imprisonment, a fine of $250,000, a period of supervised release of not more than five years, and a special assessment of $100.

Bany Nyuon33 years old, of Omaha, Nebraska, is charged with escape on or about August 4, 2024. The maximum penalty if convicted is up to 5 years in prison, a $250,000 fine, 3 years of probation, and a $100 special levy.

Brian S. Castillo23-year-old from Bronx, New York, is charged in a three-count indictment. Count I charges Castillo with conspiracy to commit bank fraud, commencing no later than January 3, 2023, and continuing through July 30, 2024. The maximum possible sentence upon conviction is not to exceed 30 years’ imprisonment, a $1,000,000 fine, a period of parole not to exceed 5 years, and a $100 special assessment. Count II charges Castillo with mail fraud from on or about January 2023 through on or about July 30, 2024. The maximum possible sentence upon conviction is not to exceed 20 years’ imprisonment, a $250,000 fine, a period of parole not to exceed 3 years, and a $100 special assessment. Count III charges Castillo with money laundering from approximately December 2023 through approximately May 18, 2024. The maximum possible sentence upon conviction is not to exceed 20 years in prison, a fine of $500,000 or twice the value of the property involved in the transaction, whichever is greater, a period of parole not to exceed 3 years, and a special levy of $100.

Sonia Martinez, age 39, And Andrew Juarez36 years old, both of Scottsbluff, Nebraska, are charged in a two-count indictment. Count I charges Martinez and Juarez with conspiracy to distribute more than 50 grams of methamphetamine beginning on or about January 24, 2024, and continuing through May 9, 2024. The maximum possible penalty upon conviction is a minimum of 15 years and a maximum of life imprisonment, a $20,000,000 fine, a period of parole of at least 10 years, and a $100 special assessment. Count II charges Martinez and Juarez with using and carrying a firearm in furtherance of a drug trafficking offense on or about January 24, 2024. The maximum possible penalty upon conviction is a minimum of 5 years and a maximum of life imprisonment, a $250,000 fine, a period of parole of up to 5 years, and a $100 special assessment.

Cleophus Necklace34 years old, of Lincoln, Nebraska, is charged with possession of a firearm by a prohibited person on or about June 10, 2024. The maximum possible penalty if convicted is not to exceed 15 years in prison, a fine of $250,000, a period of probation not to exceed 3 years, and a special levy of $100.

Michael E. Scott60-year-old from Murray, Nebraska, is charged in a three-count indictment. Count I charges Scott with distribution of child pornography on or about January 9, 2024. The maximum possible sentence if convicted is a minimum of 15 years and a maximum of 40 years in prison, a fine of $250,000, a term of parole of at least 5 years and a maximum of life in prison, and a special levy of $100. Count II charges Scott with distribution of child pornography on or about January 17, 2024. The maximum possible sentence if convicted is a minimum of 15 years and a maximum of 40 years in prison, a fine of $250,000, a term of parole of at least 5 years and a maximum of life in prison, and a special levy of $100. Count III charges Scott with possession and access with intent to view child pornography on or about July 25, 2024. The maximum possible sentence if convicted is a minimum of 10 years and a maximum of 20 years in prison, a fine of $ 250,000, a minimum period of parole of 5 years and a maximum of life, and a special levy of $100.

Angela Marie Bryant45 years old, of Lincoln, Nebraska, is charged with possession with intent to distribute 50 grams or more of methamphetamine on or about April 2, 2024. The maximum possible penalty if convicted is a minimum of 10 years and a maximum of life in prison, a fine of $1,000,000, a period of probation of at least 5 years and a maximum of life in prison, and a special levy of $100.
