Hillary Clinton suggests that American citizens should be “criminally prosecuted” for repeating so-called Russian propaganda that “promotes Trump.” Kamala Harris’ running mate, Tim Walz, has similarly argued that the First Amendment does not apply to alleged “misinformation.” The comments suggest that free speech could be at risk if the Democrats win in November.

“I think it’s important to indict the Russians, just as Muller indicted many of the Russians who directly interfered in the 2016 election and supported Trump,” the failed Democratic presidential candidate told Rachel Maddow.

“But I also think that there are Americans who are engaged in this kind of propaganda. And whether they should be prosecuted civilly or even in some cases criminally, (that) is something that would be a better deterrent, because it is unlikely that the Russians, except in a few cases, will ever be tried in the United States,” she said.

Clinton appeared to be referring to two alleged Russian shell companies—Concord Management and Concord Consulting—that the Department of Justice (DOJ) charged after Muller’s flawed investigation. However, those charges were dropped when the firms began defending themselves in court.

Clinton’s comments are reminiscent of those made by Tim Walz, the controversial governor of Minnesota and Kamala Harris’ running mate.

“There is no guarantee of free speech on disinformation or hate speech, especially when it comes to our democracy,” the Democrat said in December 2022.

Walz has taken a similarly authoritarian approach during the COVID-19 pandemic, distancing himself from Black Lives Matter riots and deploying the National Guard to shoot paintballs at suburban women on their doorsteps to enforce curfews.

Harris, during her campaign for the 2020 Democratic nomination, also threatened government action against social media platforms that did not censor content to her liking. She said: “If you are profiting off of hate, if you are serving as a megaphone for disinformation or cyber warfare, if you are not policing your platforms, we will hold you accountable.”
