Supreme Court asks for amendment to POCSO Act to tackle child exploitation

The Supreme Court on Monday recommended that Parliament amend the POCSO Act by replacing the term “child pornography” with “child sexual exploitation and abuse material” (CSEAM), which better reflects the true nature of the crimes.

A bench headed by Chief Justice DY Chandrachud suggested that the Centre may consider bringing about the amendment through an ordinance. The court in its 200-page verdict emphasised that viewing and downloading child pornography are indeed offences under the POCSO and IT Acts.

The court’s suggestions include implementing comprehensive sex education programs to deter potential offenders and raising awareness through public campaigns. The court also suggested forming an expert committee to develop robust programs for child protection, education and sexual well-being.
