Supreme Court issues landmark ruling on Child Sexual Exploitation Materials (CSEAM)

In a landmark ruling, the Supreme Court ruled that Child Sexual Abuse Material (CSEAM) violates the fundamental rights of children by reducing them to objects of sexual gratification and depriving them of their humanity. The ruling highlighted the severe mental, emotional and social consequences for victims.

The bench, headed by Chief Justice DY Chandrachud and Justice JB Pardiwala, stressed the need for robust legal and moral measures to tackle CSEAM. These measures include not only criminal sanctions for those involved but also educational and awareness campaigns to prevent the circulation of such material.

The court’s ruling overturns a Madras High Court judgment which had upheld that merely viewing or downloading CSEAM is an offence under the POCSO Act, 2012. The court also emphasised the importance of compassionate support for victims to help them heal and get their lives back on track.
