Duluth man convicted of child pornography possession in Olmsted County – Post Bulletin

ROCHESTER — A Duluth man was granted a suspended sentence Monday in Olmsted County District Court for possession of pornographic material of a minor under the age of 14.

Brandyn Scott Kane, 32, was charged with two felonies: distribution and possession of pornographic work of a minor via Kik Messenger. He pleaded guilty June 4 to possession of pornographic work of a minor under the age of 14.

After brief arguments from the prosecution and defense, District Judge Lisa Hayne sentenced Kane to a deferred imposition of up to five years. A deferred imposition occurs when the court accepts a guilty plea but does not impose a sentence.

Instead of a fine, Hayne said Kane must do 100 hours of community service in six months. Kane is also banned from going to places where children congregate.

According to court documents, Rochester police received a tip on Jan. 3 about three videos and two images of child sexual abuse that had been uploaded to Kik in September 2023. The IP address of the account belonged to a person in southeast Rochester and the account was traced to Kane.

On January 11, a search warrant was executed for Kane’s person, vehicle, and occupants. Kane was pulled over for a traffic stop and a cell phone, which Kane identified as his own, was found in his vehicle containing images of child sexual abuse.

According to the criminal complaint, Kane told police he went to child pornography websites to sell photos.
