Bail verdict for construction mafia extortion expected on Friday

Chetty said the process was flawed because five people were named when it was reported that 30 people stormed the construction site on August 22 and 23.

He also addressed a concern the state had previously raised when two suspects failed to disclose their criminal records.

Chetty said there was no reason why the suspects would not want to make their previous convictions public, as in the case of Phetha, who was charged with rape when he was 17.

“Phetha has not admitted or denied the previous convictions. He feels that the allegations have disappeared many years later. He (Phetha) was naive and a young man when the allegations were made. He also admits that he has not been convicted,” Chetty said.

Both Phetha and Khanyile filed additional statements after the state raised concerns about their previous convictions.

Matha said: “Extortion is a reality and is also increasing. If the accused are released, it could be a serious disaster for the project. Not all applicants are suitable candidates for the bail condition.”

He said It was deliberate that Phetha and Khanyile did not mention their previous convictions.

The case was adjourned until September 20 for the determination of bail.
