As Samajwadi followers and Muslim activists declare rape accused Moeed Khan ‘innocent’, here’s the truth behind the DNA test in the Ayodhya gang rape case

On Tuesday, October 1, Islamists attempted to acquit Samajwadi Party leader Moeed Khan, who was accused of raping a 12-year-old girl in Ayodhya in Uttar Pradesh. This after DNA reports in the case did not match the victim’s fetus. The DNA reports have sent a match for Raju Khan, who is also an accused in the girl’s gang rape case.

Both Moeed Khan and his driver Raju Khan are charged under various sections of the POCSO Act and the Penal Laws for allegedly gang-raping a 12-year-old Other Backward Class (OBC) girl in Ayodhya and recording the incident for the purpose of use as blackmail against her for more than two months. The victim’s pregnancy-related health problems brought the crime to light.

The submission of the first information report was postponed. Since 2012, the police station has been housed on Moeed Khan’s land. Arrests were made following public outcry and an investigation into the matter is currently underway. Amid this, several Islamists on social media tried to honestly tell the SP leader that his DNA reports did not match the fetus. They alleged that the SP leader’s name was unnecessarily dragged into the political case while it was confirmed that the real suspect who raped the girl was Raju Khan.

“Do you remember the Ayodhya rape case? The same case where Moeed Khan’s name was forcibly dragged and defamed. Yes, the same Moeed Khan whose bakery was crushed by the constitutional bulldozer. Now the news is that Moeed Khan’s DNA did not match the girl. On the contrary, the DNA of Raju, who works at the bakery, matches. Yes, the same Raju who had a love affair with the girl,” says ‘journalist’ Ali Sohrab, a claimed activist against ‘Islamophobia’.

“Aditya Nath went around the state propagating that Moeed Khan is a rapist. Who will now answer for the open defamation of Muslims?” said Anishur Rahman. Another indicated that all media personnel who identified SP member Moeed Khan as an accused will now apologise.

Wasim Akram Tyagi, a foul-mouthed Muslim fundamentalist who calls himself a “journalist” on Perhaps, according to Tyagi, proof of paternity is the single most important factor establishing rape, possibly even in cases where rape did not result in fertilization.

A similar display of low IQ was displayed by another Muslim fundamentalist disguised as a journalist. Zakir Ali Tyagi shared an interview with Moeed Khan’s family members, who would clearly vouch for his innocence, to claim that Khan was framed in the case and the DNA report only confirms this.

It is crucial to note that although the DNA reports have not found a match between the SP leader and the victim’s fetus, this does not make him less of a suspect as the burden of proof in rape incidents does not necessarily depend on fertilization . Rape is any form of sexual assault that involves sexual activity with another person without that person’s consent. It generally involves penetration (vaginal, anal or oral) by force, threat or coercion, or when the victim is incapacitated and unable to give informed consent (due to drugs, intoxication, unconsciousness, etc.) . It is a serious violation of a person’s autonomy and dignity and is punishable in many countries.

The victim’s testimony names both Moeed Khan and Raju Khan as accused of gang rape

Earlier, the victim’s testimony was also recorded in which she confirmed that she was raped by both the said suspects. According to the minor victim, about 75 days ago, when she was returning home, Raju, a clerk working at Moeed’s shop, lured the victim to his shop by giving her a toast. Since she had also gone to the store before, she trusted him and went there. It is alleged that both suspects took turns raping her inside the shop and also recorded lewd videos of the entire incident. By threatening to leak the video, they continued to sexually exploit the minor for more than two months. As a result of continued sexual exploitation, the victim became pregnant.

However, the family came to know about the crime when her health deteriorated and she became pregnant.

It is further alleged that the Bhadarsa police station has not filed an FIR in the case for more than 30 hours. It is also alleged that this police station was on the run from the house of accused SP leader Moeed Khan since 2012. The incident took place at Pura Kalandar police station in Ayodhya. Accused SP leader Khan ran a bakery near Bhadarsa outpost. The minor victim lives with her mother.

The Islamists also complained about the bulldozing action taken against the bakery of the suspect, SP leader Moeed Khan. Islamists claimed that the action was taken unnecessarily against the SP leader. However, the bakery was sealed by the food adulteration department and found illegal. Therefore, the demolition of the said illegal property was carried out.

On October 8, charges against the suspect will be filed and the trial will begin. The bail applications of the accused are pending before the Lucknow bench of the Allahabad High Court. Both suspects are currently in the district jail and their bail applications were earlier rejected by the local court.
