Man sentenced to federal prison for attempting to have sex with child who was undercover police officer

A 41-year-old Janesville man was sentenced Monday to 25 years in prison for trying to meet a child for sex in a sting involving an undercover Outagamie County Sheriff’s Office officer.

David Fuchs pleaded guilty in June to one count of attempted sexual exploitation of a child and one count of committing a sex offense by a registered sex offender.

Senior U.S. District Judge William C. Griesbach sentenced Fuchs to the mandatory minimum sentence for his offenses. According to court records, the first charge carried a mandatory minimum sentence of 15 years in prison, and the second charge carried a mandatory minimum sentence of 10 years, to be served consecutively.

Fuchs was already required to register on the sex offender registry due to 2016 convictions for attempted second-degree sexual assault of a child and second-degree sexual assault of an intoxicated victim.

According to a criminal complaint, an undercover Outagamie County police officer posed as a 12-year-old Appleton girl on Kik, an Internet messaging application.

Fuchs conducted a conversation with the undercover officer and sent sexually explicit messages and photos. In some messages, he described wanting to “teach” the 12-year-old girl about sexual intercourse, the complaint said.

In one message, Fuchs asked if he was texting a police officer. When the undercover officer asked why Fuchs was concerned, he replied that because of the girl’s age, “that means jail time,” according to the complaint.

Fuchs and the undercover officer made a plan to meet at a travel plaza in Edgerton, about 30 miles from Madison. On March 15, Fuchs arrived at the meeting site, where he was arrested by U.S. Marshals.

According to the U.S. Attorney’s Office for the Eastern District of Wisconsin, Fuchs also showed interest to the undercover Outagamie County police officer, who posed with an alternate identity, by “paying $100 to have sex with a seven-year-old girl.”

Fuchs also had contact with undercover officers from the Manitowoc County Sheriff’s Office, the Madison Police Department and the Fox Valley Metro Police Department, who also posed as underage girls, according to the U.S. Attorney’s Office for the Eastern District of Wisconsin.

None of his interactions took place with real children, according to a sentencing memorandum from his public defender.

After his time in prison, Fuchs will spend the rest of his life under long-term supervision, court records show.
