‘Concerned Women for America’ are putting serious pressure on SJSU over trans player with civil rights complaint

The organization Concerned Women for America (CWA) is putting serious pressure on San Jose State and schools that will compete against the Spartans with a new civil rights complaint highlighting the dangers of pitting female athletes against trans players, and allowing it of trans players to infiltrate women’s clubs. athletics.

The CWA’s proactive effort is a clear response to the inclusion of male athlete Brayden “Blaire” Fleming on the San Jose State women’s volleyball team.

Fleming is a 6-foot-4 male competitor, fit with significant strength advantages.

CWA files a formal complaint, highlighting the dangers of trans inclusion at SJSU

CWA filed its federal civil rights complaint with the U.S. Department of Education Office for Civil Rights (OCR), focusing on San Jose State University – holding them responsible for “willful violations of Title IX in women’s volleyball.”

There have been numerous cases where a trans athlete has been allowed to play, but this has affected both female competitors and teammates.

In addition to the dangers on the field, women are also threatened by sharing locker rooms with transgender athletes, many of whom retain male genitalia.

The formal complaints highlighted that “harm to current and future female student-athletes across the country continues.”

“Women’s sports should be for women only,” CWA CEO and President Penny Nance said in an announcement. “The sexual exploitation of female athletes in their own sports must stop.”

Although it has been framed as a political talking point by progressives, concerns have also arisen within SJSU.

San Jose State women’s volleyball co-captain Brooke Slusser joined ICONS’ lawsuit against the NCAA to emphasize that the concerns go beyond politics and, more importantly, are a real problem for women directly involved involved in this case.

Brave women do their best to kick men out of their sport, as they should

The fight to save women’s sports continues, with more developments happening as courageous individuals like the CWA team and spokesperson Macy Petty take a stand.

Petty shared CWA’s letter with OutKick and spoke with me about her team’s efforts to hold the people at SJSU, the NCAA and all competing teams accountable.

Petty, who previously competed in collegiate women’s volleyball and has firsthand experience playing against a man, highlighted the organization’s efforts to recognize the dangers of allowing trans athletes to compete against women and the responsibility that entails must result.

CWA previously took action with a civil rights complaint when Lia Thomas, a man, was allowed to compete against women, including OutKick’s Riley Gaines.

Fortunately, the efforts of Petty and other women were not in vain.

And the impact of these courageous women’s voices quickly became apparent.

On Wednesday, Utah State became the fourth school to withdraw from competition against San Jose State and Blaire Fleming.

Despite remaining silent about their reasoning for forfeits, all four schools – Southern Utah, the University of Wyoming, Boise State and Utah State – have been made aware of growing concerns about protecting their female athletes by choosing NOT to contest SJSU to compete.

Utah State withdrew from the game, which was weeks away.

Petty raised this point – also highlighted in CWA’s complaint to SJSU and rival schools in the Mountain West Conference – with a post on her X account; coincidentally, hours before Utah State withdrew from the game.

The pressure is great.

“Female athletes are already going to court,” Petty posted on X.

She added: “Schools are knowingly exposing them to an increased risk of injury when they place them on a field with a man. Without the girls’ safety in mind, schools may at least choose to protect their pockets.”

Utah State made its announcement before removing the statement from its website:

The statement read: “Utah State University will not participate in the scheduled October 23, 2024 volleyball match at San Jose State University. The university will adhere to Mountain West Conference policy regarding how this match is recorded.”

Hold people accountable for this mistake

With their forfeits, Southern Utah, Wyoming, Boise State and now Utah State all accept losses in their records.

Is it worth it? In the name of protecting women, it certainly is.

However, the women at SJSU don’t get a chance to compete despite having an undefeated record That is inflated with every forfeiture.

As OutKick’s Dan Zaksheske wrote Wednesday, the Mountain West Conference has a growing problem as more schools unite on this common sense issue.

The conference can take refuge behind the NCAA’s transgender student-athlete participation policy, but the policy is not mandatory.

Schools that willingly compete with SJSU — as well as Sparta’s administration, which allows Fleming to take the court and share the women’s locker room — act oblivious to this clause and deliberately endanger their women.

CWA’s Penny Nance also said the inclusion of trans athletes is nothing more than a “social experiment” with real-world crises – more of which are waiting to manifest.

Colorado State, which will compete with SJSU (barring any new developments), promised to play Fleming and the Spartans on Thursday evening under the guise of diversity.

The cowardice of not holding these schools accountable still exists.

CWA, along with Macy Petty, continues to do its part to bring attention to this before more women fall victim to this false title of inclusion.

Concerned Women for America (WA), the nation’s largest public policy organization for women, files this formal complaint with the U.S. Department of Education Office for Civil Rights (OCR) against San Jose State University (SJSU) for its egregious violations of the protections for women on the basis of sex, established more than half a century ago in the historic passage of Title IX of the Education Amendments of 1972. The violations not only occurred within the required 180 days, but also to the detriment of current and future female student-athletes across the country, it’s happening.

In April 2024, a news article reported that a 6-foot-1 biological male player was listed as Blaire Fleming had secretly competed on the SJSU women’s volleyball team.

Formerly known as Brayden, Fleming previously competed for the National Collegiate Athletic Association (NCAA) Division I Coastal Carolina University and competed for the SJSU women’s team during the 2022 and 2023 seasons. SJSU returned Fleming to a scholarship as a redshirt senior for the season 2024-2025 in the position of outside and right hitter.

Fleming is biologically a male who should be ineligible to compete in women’s sports under current federal law, depriving biologically female athletes of the safety, privacy and competitive fairness that Title IX affords them on the basis of gender.
