Wilson v. Midland Cty.2024 BL 322113 (Article)

Problem:

May a former prisoner, who is no longer in custody, bring a civil rights action establishing the unconstitutionality of his conviction without demonstrating that his action has been favorably terminated? The en banc Fifth Circuit agrees with the First, Third, and Eighth Circuits and says they cannot. The Second, Fourth, Sixth, Ninth and Eleventh Circuits say they can.
