Sean Combs’ lawyers are appealing and asking for provisional release

Sean Combs’ lawyers are appealing and asking for provisional release.

Sean Diddy Combs’ legal team has filed an appeal seeking his release from prison ahead of his trial. According to court documents, attorney Alexander AE Shapiro filed an appeal with the United States Court of Appeals for the Second Circuit on Tuesday, October 8.

The filing states that Combs “was denied parole pending trial despite his willingness to adhere to strict conditions that would eliminate any potential risk of flight or danger.”

In the filing, Shapiro says the court “rejected a clearly adequate bail package” for Combs and “breached his obligations under the Bail Reform Act.”

“Mr. Combs is presumed innocent. He traveled to New York to surrender because he knew he would be charged,” the filing said. “He took extraordinary steps to demonstrate that he intended to face and fight the charges, not flee. He presented a bail package that would clearly prevent him from posing a danger to anyone or contacting witnesses. According to the Bail Reform Act, “liberty is the norm, and detention before trial or without trial is the carefully limited exception.” “

Combs, 54, was taken into custody at a Manhattan hotel on Sunday, September 16. He is charged with racketeering, sex trafficking and transportation for the purpose of prostitution. He is currently being held at the Metropolitan Detention Center in Brooklyn.

Bail denied

On Tuesday, the Southern District of New York’s ruling denying Combs bail was appealed, citing claims of witness tampering and obstruction of justice. His legal representatives are asking for his immediate release under appropriate bail conditions.

Combs was initially denied bail by a federal judge on September 17. His legal team immediately appealed and went back to court the next day, September 18. Once again, SDNY’s Judge L. Carter bail deniedwhich states: “There is no condition or combination of conditions to ensure that he will not obstruct justice or tamper with witnesses.” Shapiro’s appeal was filed a week after he indicated he planned to appeal on September 30, two weeks after Combs’ arrest.

Combs, who has pleaded not guilty, is facing allegations that he pressured women to participate elaborate sexual performances called ‘freak-offs’. It is alleged that he exploited his fame, influence and substances such as cocaine, oxycodone and ketamine to force women to perform these acts on male sex workers, then administered IV treatments to help them recover.

Additionally, Combs is accused of physical abuse and allegedly recorded the “freak offs” without the victims’ consent. In March, authorities searched his homes in Los Angeles and Miami, where they seized several items linked to the “freak offs,” including drugs and more than 1,000 bottles of lube and baby oil.

Combs’ mother

Combs’ mother has said she is “devastated and deeply saddened” by the allegations against her son, claiming they are “lies.”

The artist, famous for his 1997 hit “I’ll Be Missing You,” was arrested last month on sex trafficking and racketeering charges. He is currently being held in a Manhattan detention center after being denied bail. In a statement, Janice Klein Combs stood by her son, acknowledging that while he “has made mistakes in the past, as we all have,” he is “not the monster they made him out to be.” “It is heartbreaking to see my son not being judged based on the truth, but based on a story made up of lies,” she stated.

This statement was released by her lawyer, Natlie G. Figgerson behalf of Mrs. Small Combs and the Combs family. The statement followed news that Mr. Combs could face lawsuits from more than 100 additional plaintiffs, both men and women, for assault, rape and sexual exploitation.

His legal team has denied these and all previous allegations, labeling them as ‘false and defamatory’. Since last year, he has been involved in several lawsuits, including one brought by his former partner, Cassie Ventura, who accused him of rape and assault. Mr.

Combs denied these allegations and the case was settled out of court just a day after it was filed. However, he was later sued by twelve other women, many of whom alleged that the rapper drugged and assaulted them. In March, federal agents conducted raids on his property as part of an ongoing criminal investigation.

In May, a video surfaced showing Mr. Combs physically assaulting Ms. Ventura in a hotel room in 2016. In her statement, Ms. Small Combs acknowledged the video and clarified that she is “not here to portray my son as perfect painting because he doesn’t.”

“My son may not have been entirely honest about certain things, such as denying that he was ever violent with an ex-girlfriend when hotel surveillance showed otherwise,” she said.

Janice Small Combs argued that one lie did not make him guilty of all the other “abhorrent allegations and the serious accusations made against him.”

“It is truly painful to watch the world so quickly and easily turn on my son over lies and misconceptions, without ever hearing his side or giving him the opportunity to present his side,” she said, adding that she believed some of his accusers were. motivated by money.

P. Diddy has to appear in court next time Wednesday October 9when his lawyers will argue for his release on bail.
